THE RED HERRINGS OF MUFTI EBRAHIM DESAI SAHEB
 
(RED HERRING: Something intended to divert attention from the real problem or matter at hand; a misleading clue. Also called red-herring prospectus.)
 
Anyone who has followed the series of responses and tailor made queries of Mufti Ebrahim Desai Saheb will pick up that he has been academically dishonest, evasive and sarcastic in his responses or “responses”.
At a time when masaajid had been shutting down and the Ummah needed direction and directive, even when government didn’t call for such, he remained silent on the issue. When such silence was brought up by The Majlis he used red herring responses and started talking about husne zan, which had nothing to do with the clear cut hurmat of musjid closure.
 
When WIFAQ SA and others exposed his academic dishonesty regarding quoting yawning texts to prove masks in Salah, he, knowing full well that Mufti Salejee Saheb doesn’t base fatawa on dreams, played another red herring, by evading and speaking about the role of dreams in sharia. Mufti Salejee Saheb was giving encouragement and warning and one does not need to be a Mufti to understand this. Hazrat Moulana Yunus Patel Saheb Rahmatullahi Alay did this often in his Majaalis.
 
Now when his 2014 stance was shown, he calls it a mere translation? What does that even mean? He called the translation of Sahabah asking for plague to afflict their family while In the Musjid (note that there were Musallees in the Musjid during a PLAGUE), stating that pious people from before died from such Iman and Yaqeen. Is it a problem for any Muslim to die by acting on Imaan and Yaqeen? Does any true Muslim (Mufti or layman) have a problem with this? How does that fit in to compromising acts of worship due to such?
 
He states: “It is not against Imaan and Yaqeen to adopt means to safeguard and protect oneself from the plague.” This is not a plague! One of his Fataawa state that the Hadith on not entering or leaving a place is CONFINED TO PLAGUE AS DEFINED BY ACTUAL PLAGUE. Furthermore we would like to remind him that it is against Imaan and Yaqeen to TAKE PRECAUTIONS which are against the Shariah and in conflict with the Mubarak Sunnah. If one has to look at the Sahaaba’s position, one can come to the old saying that actions speak louder than words.
 
He talks about mere taking medicine or precaution when the matter at hand is causing a break in sufoof and committing a Makrooh act based on a reason (Illat) that existed in the time of sahabah.
Then when his reasoning of onions had been broken down, instead of trying to prove that, he jumped to vaccines.
He ludicrously tries to compare the vaccine roll-out, which even the manufacturers pulled back, to the flu vaccine.
Every sane person knows the mask notices (and notices of social distancing) are all over as a formality. How does he come to the conclusion that such a sign shows approval of masks? Even those who are against masks are forced to use it for shopping and to save ourselves from Zulm at certain times. We know of no other Musjid that says, carry masks but do not wear them in Salaat-Perhaps readers can correct us. He conveniently missed that part!
Honestly and with due respect, it unfortunately seems like we are dealing with a child playing tit for tat instead of giving clear cut answers to questions posed or responses made. He tries to say that The Majlis calls for masks, due to a sign encouraging mussalis not to wear such in Salaah. Will any person who knows the stance of Majlis over decades on many matters really accept that? What next! Will he look for spelling errors as well!
 
He does the same thing regarding Mufti Salejee. Does any rational person actually believe or understand that Mufti Salajee promotes social distancing by stating that those who fear illness and contagion may perform Salaat on the other end of the Musjid or pass Fataawa based on dreams!
 
Below is a point that everyone should take note of and perhaps try and practice.
We know of Muslims who brought shops to a standstill because they refused to wear masks on the basis that no social distancing was taking place in these shops and malls. They encouraged managers to call the police. NO ONE EVER DID! Because they knew that they were also in violation of the law.
 
We know of Muslims who stopped to challenge police to give their colleagues fines when they saw them not wearing masks.
 
We know of Muslims who asked police to stand away from them in compliance with law at roadblocks. We can tell you many stories like this. Can our pro protocol Muftis and Muslims claim that they have done this? Actually we see them ignoring protocols in almost every aspect of life accept for the Houses of Allah Ta’Aala.
 
Coming back to Mufti Ebrahim Desai. One does not need to be an Aalim to see the difference between permissibility and being forced. So if we had to agree (for just this moment, and we don’t), he is promoting vaccines that are being forced on people (directly or indirectly) as opposed to the statements of the Ulama of old that it is PERMISSIBLE (NOT A SIN).
He quotes Hakeemul Ummat but fails to see that Hazrat spoke about taking medications IF AFFLICTED. One cannot take a vaccine IF AFFLICTED.
 
So many of the statements he produces states that the “medicine” must be proven beneficial or tried and tested.
In keeping with the above he states that his Darul Ifta met with experts. What about experts who say that it is dangerous? What about the side effects and deaths we are seeing on account of this “medicine”. Are we to just turn a blind eye to all this?
Then he publishes his responses without taking his own words into consideration with his sarcasm and nit picking (in that he Addresses Moulana AS Desai of The Majlis in the following manner) :
 
“Muhtaram Moulana you are my senior, I overlook the references, bootliker,sram, voetsack, scoundrel, cesspool of inequity to me. Indeed, I am worse than that. I therefore I humbly request you to make dua for my islah and husn kaatimah.
I am also guided by the Mubarak hadith of Rasulullah Sallalahu Alaihi Wassalaam that to swear a Muslim constitutes Fisq. Such a person becomes a faasiq and he should make tawba. Such vile acts could deprive one of husn kaatimah.
I apologise for any disrespect shown to you in this correspondence. I request your pious duas during these Mubarak moments.” (End of respectful statement and advice to his senior)
While the majlis states things as it is without formality, mufti Desai Saheb employs cunning social status mechanisms to insult and to demean. Victim playing and passive attack is one of his main weapons in his inventory
He does not make open mention of the fact The Majlis stated, that Moulana Thanvi Rahmatullahi Alay, that Hazrat erred in ASSIGNING THE MATTER TO CHOICE AND OPINION OF EVERY PERSON. He portrays this as Hazrat having erred in manner of making Kufr.
 
Maulana Ashraf Ali thanvi rahmatullahi ALAIH stated himself that precautions and means are asbaab zanni ie uncertain causes and praiseworthy for Ulama and Sulaha to leave out.
 
We (Qalamul Haq) are not Ulama. We do however learn from and take Mashwara with many, many Ulama and some even assist us in writing our articles. So if our response does not cover everything in full or our response is not up to standard, then this is understandable. But for the responses, statements and Fataawa of a senior Mufti, this is simply unacceptable.
 
May Allah Ta’Aaala guide and protect us all and guide Mufti Ebrahim Desai back to Haq and Siraatal Mustaqeem.
